Privacy Policy
Rocky Climbing (the “Company”). Sets forth this Privacy Policy (the “Policy”) with regard to the treatment of users’ information, including but not limited to personal information, during the performance of services provided by the Company (the “Services”), as follows;
1. Privacy Information
- For the purpose of this policy, as a part of Privacy Information, “personal information” indicates “personal information” under Act on the Protection of Personal Information, and it means information relating to a living individual containing a name, date of birth, or other descriptions etc. whereby a specific individual can be identified or containing an individual identification code.
- As a part of Privacy Information, “Historical and Specification Information” is other than Personal Information, and it includes information about the used services, purchased items, vied pages and advertisements, used keywords, date of use, way of use, usage environment, zip code, sexuality, jobs, ages, IP address, cookie information, log information, terminal information etc.
2. Collection of Privacy Information
- The Company may ask users their Personal Information including name, birth date, address, phone number, mail address etc. at the time of registration. In addition, the Company may collect transaction report or transmission report which may contains users’ Personal Information through the Company’s partner companies (including advertisers or advertising companies).
- The Company may collect the Historical and Specification Information such as information about the used services, purchased items, vied pages and advertisements, used keywords, date of use, way of use, usage environment (when it is used by the mobile devices, the condition of connection and the settings for connections are included), zip code, sexuality, jobs, ages, IP address, cookie information, log information, terminal information etc., when users use the Service of the Company and its partner companies, or views the site of Company and its partner companies.
3. Purpose of Collection
The Company collects the Privacy Information for the following purposes:
- (1)providing users with information such as name, address, contact, way of payment and other registered information, used service, purchased items, and its price, in order for users to check and review;
- (2)using information such as name and address, in order to notice users through emails or to send items to users etc.;
- (3)using information such as name, birth date, address, phone number, bank account number, credit card number, driving license number, the record of registered letters etc., in order to identify users;
- (4)using information such as name and number of purchased items, types and terms of used Services, the amount, name, address, bank account number, credit card number etc., in order to request payments;
- (5)transferring information to input boxes or other services (including services provided by partner companies) pursuant to users’ direction, in order for user to facilitate input;
- (6)using information such us way of use, name, address etc., in order to decline from use by the users who infringed the Terms and Conditions of the Service, or use by the users with unfair purposes;
- (7)using information which is necessary for providing Services such as inquiry from users, or billing information, use of service, contact etc., in order to respond inquiries from users; and
- (8)other purposes incidental to the foregoing.
Article 4 Provision of Personal Information to Third Parties
- Unless required by the Personal Information Protection Act or other applicable laws and regulations, the Company shall not provide any third party with users’ Personal Information without prior consent of the user, unless:
- (1)it is based on laws and regulations;
- (2)there is a need to protect a human life, body or fortune, and when it is difficult to obtain a principal's consent;
- (3)there is a special need to enhance public hygiene or promote fostering healthy children, and when it is difficult to obtain a principal's consent; or
- (4)there is a need to cooperate in regard to a central government organization or a local government, or a person entrusted by them performing affairs prescribed by laws and regulations, and when there is a possibility that obtaining a principal's consent would interfere with the performance of the said affairs
5. Disclosure of Personal Information
- Upon request from the user to disclose its personal information under the Personal Information Protection Act, the Company shall, without delay, disclose to the user such information after confirming its identity to the extent required to do so pursuant to the Personal Information Protection Act and other applicable laws and regulations. Please note that you must pay a commission (JPY 1,000 per one application)for disclosure of personal information.
6. Correction and Deletion of Personal Information
- In cases where the personal information which the Company has is wrong, the user can request its correction or deletion in accordance with the procedures specified by the Company.
- When the Company determines that the Company needs to correct or delete pursuant to the request from the user, the Company shall, without delay, correct or delete such personal information and notify the consequence to the requesting user.
7. Suspension of Use and Deletion of Personal Information
- If the Company is required by the user to suspend use of or to delete personal information because such information is being handled beyond the scope of the purpose of the use previously made public, or has been collected in a fraudulent or otherwise illicit manner, the Company shall, without delay, conduct an appropriate investigation, and based on the results, suspend of use or delete such personal information and notify the consequence to the requesting user. However, suspension of use or deletion of such personal information requires a large amount of expenses or other cases where it is difficult to fulfil suspension of use or deletion of such personal information and when necessary alternative action is taken to protect a principal's rights and interests, the Company may take alternative action.

Article 9 Amendment
- The Company reserves the right to change this Policy without any notice to users. Amended Policy shall be effective when the Company uploaded the Policy to this website; provided, however the Company shall obtain approval from users if such amendment requires users’ approval.
